1. Right of withdrawal

If you are not satisfied with the products purchased, solely and exclusively, in the online store www.xgreens.eu, you have the right to withdraw from the contract by returning your purchases, in accordance with the provisions of the following sections:

Deadline for exercising the right of withdrawal

You can exercise the right of withdrawal without justification within a period of 14 calendar days for all items.

  • The withdrawal period will expire 14 calendar days from the day you or a third party indicated by you, other than the carrier, received the good.
  • In the exceptional case that in the same order you have purchased multiple goods that have been delivered to you separately, the withdrawal period will expire 14 calendar days from the day you or a third party indicated by you, other than from the carrier, you received the last of those goods.
  • In the event that you have purchased a good made up of multiple components or parts, the withdrawal period will expire 14 calendar days from the day you or a third party indicated by you, other than the carrier, received the last component or materials.

Consequences of withdrawal

In the event that you exercise the right of withdrawal, we will refund all payments that we have received from you, excluding delivery costs, without undue delay and, in any case, no later than 14 calendar days from the date in which you inform us of your decision to withdraw from the contract.

We will proceed to make said refund using the same means of payment in which the purchase was paid or, where appropriate, via bank transfer, prior agreement with the consumer, without incurring any expense as a result of the refund except for expenses return of the product.

We may withhold reimbursement until the returned goods have been received or until you have provided reliable proof of return.

In other words, the objective and justified loss of value that may be due to the costs that must be incurred, for example, to clean or repair the goods or when the goods cannot be sold as new, but as second-hand.

You cannot withdraw from the purchase of products that have been ordered from XGREENS “ex profeso” or in other legally excepted cases. In the case of promotions in which several independent items are purchased as part of the same set, in case of withdrawal, all the products included within it must be withdrawn.

Under no circumstances will returns of products that have not been purchased in Spain be accepted. The right of withdrawal regulated in this section will only be applicable to products purchased, solely and exclusively, through the online store www.xgreens.eu, so in no case will it be applicable to products purchased in a store. physics.

How to exercise the right of withdrawal

  • Without prejudice to the provisions of the two preceding paragraphs, you may also choose to exercise your right of withdrawal by completing and sending by email from our contact form the withdrawal form that you can download below, in which case, we will notify you without delay by email of receipt of said withdrawal.

The right of withdrawal will be understood to be exercised within the term when you have sent us the communication regarding the exercise of this right before the end of the corresponding term, in the terms indicated above. In this sense, you should only have previously carried out the same manipulations and inspections of the products that would be admitted in a store. It is understood that in a store you could not see a machine in operation, since its use leaves marks, which make the value of the good decrease.

Exceptions to the right of withdrawal

The User acknowledges knowing that there are exceptions to the right of withdrawal, as stated in article 103 of Real Decreto Legislativo 1/2007, of November 16, which approves the consolidated text of the Ley General para la Defensa de los Consumidores y Usuarios y otras leyes complementarias.

In a merely illustrative and non-exhaustive way, it would be the case of:

  1. The provision of services, once the service has been fully executed, and if the contract imposes a payment obligation on the consumer or user, when the execution has begun, with the prior express consent of the consumer or user and with the knowledge on his part that, once the employer has fully executed the contract, he will have lost his right of withdrawal.
  2. The supply of goods or the provision of services whose price depends on fluctuations in the financial market that the employer cannot control and that may occur during the withdrawal period.
  3. The supply of goods made according to the specifications of the consumer and user or clearly personalized.
  4. The supply of goods that can deteriorate or expire quickly.
  5. The supply of sealed goods that are not suitable for return for reasons of health protection or hygiene and that have been unsealed after delivery.
  6. The supply of goods that after their delivery and taking into account their nature have been mixed inseparably with other goods.
  7. Contracts in which the consumer and user have specifically requested the employer to visit them to carry out urgent repair or maintenance operations; If, during that visit, the entrepreneur provides additional services to those specifically requested by the consumer or supplies goods other than the spare parts used necessarily to carry out maintenance or repair operations, the right of withdrawal must apply to said additional services or goods.
  8. Contracts entered into through public auctions.

2. Our voluntary returns guarantee in addition to your legal right to withdraw

This right is additional to the rights recognized in the Consolidated Text of Ley 1/2007 of November 16 on the Defense of Consumers and Users, modified by Ley 3/2014 of March 27. The amount paid for those products that are returned due to a defect, when it actually exists, will be fully refunded, including delivery costs and the costs that the User may have incurred to make the return.

The refund will be made through the means of payment that was used in the purchase or, where appropriate, via bank transfer, prior agreement with the consumer and at no cost.

XGREENS will not refund the amount or carry out any reshipment of merchandise until the receipt and state of packaging, of the product and accessories of the item subject to the return due to withdrawal or exchange have not been verified in our warehouses. The price to be returned is the one that originally appeared in the order.

Once the correct state of the returned product has been verified, XGREENS will proceed to refund the amount within a maximum period of 14 days.
